1. Scope

These General Terms and Conditions (GTC) apply to all charter trips of Cloud 7 Capital GmbH (lessor) with the yachts shown on www.ramsesdenia.com.
The customer is hereinafter referred to as the “charterer.”
By completing the booking, the charterer accepts these GTC.

2. Scope of Services / Charter with Skipper

• Yacht exclusively with a professional skipper.
• No handover to the charterer.
• The charterer is a guest; the skipper decides on all nautical, technical, and safety-related matters.
• Start/end port: Denia (Alicante), Spain.
• Yacht corresponds to the description on the website.

3. Cruising Area

• Spanish Mediterranean coast & Balearic Islands.
• Trips outside this area only with written consent.
• Skipper decides on safe routes.

4. Booking & Payment

4.1 Charter Fee

• Online booking via www.ramsesdenia.com.
• Full payment by credit card (Visa, Mastercard, Amex) upon booking.
• Booking is valid after successful payment and confirmation.

4.2 Skipper & Cleaning

• Costs not included in the charter fee.
• Cash payment before departure to skipper or staff.

4.3 Fuel

• Direct payment by the charterer at the fuel station.
• Accepted payment methods: as available at the fuel station.

4.4 Additional Costs

• Berthing fees outside Denia / extras after charterer’s approval.
• Credit card pre-authorization possible.

5. Charterer’s Obligations

• Careful handling of yacht and inventory.
• Compliance with skipper’s instructions.
• Prohibited: illegal substances, excessive alcohol consumption, dangerous behavior, interference with technical equipment.

6. Liability & Damages

• No security deposit.
• Charterer is liable for damages caused by them.
• Skipper errors: responsibility lies with lessor/insurance.
• Personal belongings are not insured.

7. Start & End of Charter

• Start/end: boarding/disembarking the yacht in Denia.
• No handover protocol.
• Skipper documents the yacht’s condition.

8. Weather & Safety Decisions

• Skipper decides on departure, route, and possible cancellation.
• No departure in case of storm, heavy seas, heavy rain/thunderstorms.
• Changes are for safety reasons.

9. Cancellation

9.1 By Charterer

• Up to 5 days before: free of charge.
• 3 days before: 50%.
• 1 day before: 75%.
• On charter day: 100%.

9.2 Weather-Related

• Free of charge in case of safety-relevant weather conditions: storm, high waves, heavy rain, thunderstorms.
• Option: free rebooking subject to availability.

10. Limitation of Liability

• Liability only for intent and gross negligence.
• No liability for restrictions due to weather or official regulations.

11. Data Protection

• Personal data is processed in accordance with GDPR & LOPDGDD.

12. Jurisdiction & Applicable Law

• German law applies.
• Jurisdiction: Munich, as far as legally permissible.
